Restricted: Ethics and Privacy

The work is restricted in its use in one of the following ways: the end user must be known to the provider of the data, and/ or can only access the data under controlled conditions. Publication of derivatives to be agreed with the data provider.

A work provided under this license is free, but not open due to ethics and/ or privacy considerations. For a work to be licensed it must pass the ethics and privacy test.

The owner or provider of the work can take reasonable steps to verify the identity of the end user of the work, to control access to the work, and to limit the application of derivatives of the work.


Privacy and Ethics Test

 

  1. If the work is subject to provisions of the Protection of Personal Information Act then this license applies.
  2. If the work is not subject to the act, but one of the following statements are true:
    1. Disclosure may harm the interests on an individual (for example the personal tax or health records of an individual)
    2. Disclosure may harm the interests of a community (for example the location of a natural resource currently exploited by the community)
    3. Disclosure may harm our environment (for example location of endangered species).

 

The owner or provider of the work can take reasonable steps to verify the identity of the end user of the work, to control access to the work, and to limit the application of derivatives of the work.

 

Reasonable Restrictions on Access

 

The owner of the work can take reasonable actions to manage and control access to the work and to limit the application of derivatives from the work.

  1. Require the identity of the end user to be recorded in the case of automated electronic access.
  2. Require the end user to motivate use of the data and how it will be applied.
  3. Require the end user to access the data only in person and/ or on premises controlled by the owner of the work.
  4. Require the end user to depersonalise, aggregate, or otherwise modify the derivative work so that disclosures as described above cannot be made.
